YAKIMA, Wash. (AP) — Kittitas County prosecutors charged Yakima County Prosecutor Jim Hagarty with drunken driving on Thursday in Yakima County District Court.

Yakima Herald-Republic reports (http://is.gd/0ZADtK) he is scheduled to appear in court on the gross misdemeanor charge on Dec. 12 before a judge visiting from Kittitas County, which agreed to handle the case.

Hagarty was arrested by a Washington State trooper on Nov. 15 after a minor rear-end collision at Selah. He provided breath-test samples of 0.106 and 0.109, slightly over the legal limit of 0.08 percent.

The 61-year-old Hagarty has been the Yakima prosecutor for three years. He issued an apology the day after his arrest but has since refused comment.
