Man sues Port of Vancouver over crash

Port-owned vehicle pushed parked car into him, suit claims

A man is suing the Port of Vancouver and a man and his wife after a port-owned vehicle allegedly crashed into a parked car, pushing it into him.

James Biegler filed the lawsuit Sept. 30 in Clark County Superior Court against the port and James Styres, a port employee at the time of the incident, and Styres’ wife, who is only identified as Jane Doe Styres.

According to the suit, on Aug. 14, 2012, Biegler was walking between his car and another unoccupied parked car when a port-owned vehicle driven by James Styres struck the other car and pushed it into Biegler and his vehicle.

The lawsuit alleges that Styres failed to maintain control of his vehicle, exceeded the reasonable safe speed, failed to exercise ordinary and reasonable care under the circumstances, failed to stop and disregarded the safety of others.

Biegler had to seek medical attention following the incident, which has caused him to incur medical, travel and other expenses, the suit says. Biegler has suffered damages in an amount to be determined at trial.

He also argues his earning capacity has been impaired and he’s lost wages. Biegler has incurred physical disability in connection with the incident, as well as mental and physical pain, which has led to the loss of enjoyment of his life, the lawsuit says.

Biegler is seeking relief in amounts to be proven at trial.

He is being represented by Baumgartner, Nelson & Wagner of Vancouver.

A spokeswoman for the port, Magan Reed, declined to comment on the pending litigation.
