An Evergreen Public Schools substitute teacher accused of molesting a physically disabled female student at a school was arraigned Wednesday in Clark County Superior Court.

Mark A. Lugliani, 59, of Battle Ground has been charged with third-degree child molestation.

The alleged abuse occurred March 29 but was not reported until early May, court records say.

According to an affidavit of probable cause, Lugliani forced a girl into a classroom closet, where he inappropriately touched her and masturbated on her.

He attempted to have sexual contact with her again the next day, but she successfully refused. The victim didn’t see Lugliani again until May 3, when he asked her to meet him. That’s when she reported the abuse to a school counselor, the affidavit states.

Lugliani was immediately removed from the substitute teacher roster when the alleged abuse was reported, Evergreen Public Schools spokeswoman Gail Spolar previously told The Columbian.

Lugliani had been a substitute teacher with the school district since January 2012 and taught at the district’s middle and high schools, Spolar said.

During Wednesday’s brief hearing, Lugliani was not in custody. He wore street clothes, flanked by defense attorney Todd Pascoe, and only spoke to confirm for Judge Gregory Gonzales that he was willing to waive his right to a speedy trial.

Gonzales set a September trial date.

Senior Deputy Prosecutor Jeannie Bryant said the state would be filing a new protective order that bars Lugliani from contacting his alleged victim, or coming within 1,000 feet of schools.
