State Rep. Richard Curtis, R-La Center, admitted to having sex with a man he met at an adult video store in Spokane last week, according to a police report released Tuesday afternoon. 

The police report offers a damning and far different version of events from the brief account Curtis gave to The Columbian Monday, one that seems likely to threaten Curtis’ political future.

The report is filled with graphic details of an encounter that began at a porn store on a Spokane Valley strip and concluded miles away in Curtis’ room at the city’s poshest hotel.

The police report contains an account of how Curtis allegedly donned women’s clothing, red stockings and a black sequined lingerie top before engaging in a sex act at the store. He continued to wear them throughout the night under his clothing.

Spokane police have finished their investigation and referred the case to the prosecutors for possible filing of extortion charges against Cody M. Castagna.

Castagna is a 26-year-old waiter from the Spokane area who allegedly tried to blackmail Curtis for $1,000 and threatened to reveal his “gay lifestyle” to the lawmaker’s wife if he did not pay.

Curtis, 48, is married and has two daughters. The two-term legislator and retired fire department captain was in Spokane last week for a retreat with other Republican lawmakers in preparation for the 2008 Legislature.

During a brief phone interview with Columbian Editor Lou Brancaccio Monday afternoon, Curtis said he did not have sex with the man and is not gay.

According to the police report, Curtis allegedly offered to pay $1,000 to have unprotected sex with Castagna.

“I feel that, honestly, I’m being wrongly accused and that (Curtis) is using his power to take it off of him and put it on me,” Castagna told reporters during a press conference Tuesday. “He has completely changed what actually happened and turned it around for his favor.”

“He didn’t make any threats against this guy (Curtis),” added Castanga’s attorney, David Partovi. “This is an extremely a low-level situation that’s being blown out of proportion by somebody who is trying to save themselves.”

Curtis did not return calls seeking comment Tuesday. He initially told police that he did not have sex with the man but later recanted, according to the police report. He also told police that he thought he might have been given some type of drug because his memory of the evening was hazy.

After the two men apparently had sex, Castagna allegedly left the hotel room with Curtis’ wallet, the report says. Curtis agreed to give the man $200, which he left at his hotel’s desk, only to be confronted with a demand for an additional $800, the report says.

Spokane Police Detective Tim Madsen wrote in his report that Curtis wanted to keep the whole incident quiet. At one point, Madsen told Curtis that “the toothpaste was already out of the tube.”

“Curtis told me he was just trying to put the cap back on the tube,” Madsen wrote. “I told Curtis that the suspect may victimize other people in the future, and Curtis acknowledged that part of his job was to protect people in the state of Washington. … Curtis said he wished he would have just paid the additional money to the suspect because he didn’t wish the case to be prosecuted. If the incident became public, it could cost him his marriage and career.”

Madsen, in his report, said Castagna told him that Curtis wouldn’t say what he did for a living.

“I work to help people out,” Curtis reportedly said, before adding, “If I told you, I’d have to kill you.”

Castagna said Curtis told him that “his wife knew he liked men when they got married, but she was not into that, so he only did that when he was out of town,” the detective wrote in his report.

The entire incident might have never come to light if Curtis hadn’t contacted Sgt. Roy Rhine of the Washington State Patrol. Rhine, who works out of the patrol’s Southwest Washington office, is a fellow Republican who has run for the state Legislature.

According to a Madsen’s report, Curtis contacted a friend in the Washington State Patrol and wanted the agency to investigate “because the local police would talk and it would get out to the press.” The WSP referred the case back to local officials.

The police report and court filings say that Curtis met Castagna at a Hollywood Erotic Boutique store at about 12:45 a.m. Friday and later rendezvoused at Curtis’ room at the Davenport Tower Hotel at about 3:35 a.m.

As part of their investigation, Spokane police have seized video recordings from the hotel and the sex shop, computerized records of when Curtis’ hotel room door was opened and closed, and hotel records purportedly showing the rental of gay porn movies by someone in Curtis’ room.

Castagna’s Myspace.com Web page indicates that he is gay. A search for Castagna in court records turned up a number of cases in Spokane and King County on a variety of charges. Most cases were in juvenile court and involved charges of assault, theft, burglary and malicious mischief.

As an adult, court records showed that Castagna pleaded guilty in 2001 to a forgery charge and was sentenced to two months in jail and 12 months in community custody.

Partovi said he called the press conference Tuesday due to the severity of the charges being considered against his client.

“Extortion is a violent Class B felony. It starts with a serious jail sentence, and this guy (Castagna) didn’t do anything wrong — at that level, anyway,” Partovi said.

It is interesting that in this case as with Larry Craig, the first thing they want on the record is they are not Gay. Actually they may not be lying in the sense that some on the "down low", just as in the case of prison sex, are actually heterosexual but just looking for quick sex where they can get it and objectifying the person giving them what they want to the point they do not see it as gay sex and might prefer a female if getting their sexual release were as easy and convenient as on the "down low". It is common with sexual addiction.

But whatever this legislator is or is not, he cannot claim not being a hypocrite; especially as a member of the Republican Party and Christian Coalition type.

What is so sad is for his wife and children. Even for those who have serious issues with the hypocrisy, homophobia and judgmentalism of the Republicans, this should not give cause for any kind of joy or celebration as real innocents have been harmed in ways that will last for many years.

He and his wife should see their physician to see if their health may have been compromised and their children should be shielded from the media storm that will follow.

I can only hope that the Cowlitz casino tribal interests are as appalled as I am. And that they prove it by avoiding the La Center area forevermore.

A part of me is laughing, though. Curtis would wave his pocket bible in people's faces and tell us he found all his answers therein. Apparently the bible plus the erotic boutique, gay XXX porn and high-priced man candy were needed to cover all his varied interests.

The stench of hypocrisy is thick over La Center tonight. I feel sorry for his family. I haven't got any sympathy for Curtis himself.

You are either a member of the tribal council who gets paid $70,000 a year to agree with everything the Barnetts say or lose you annual income or you are someone who stands to gain. All you say is all about how bad La Center is. Put your money where you mouth is and give some history about La Center, the schools, the economy, why (in numbers) it would help the town or why (in numbers) it would not. The town is not perverted. It has a few corrupt leaders who WANT a casino and aren't listening to citizens who DON'T want one. I'm so curious. Where do YOU come by your animosity towards the town? Could you lose your annual income if this doesn't occur? Really curious here as you always respond to this issue so passionatelyg but I've noticed that mainly, everywhere else, you just post news articles. You live here? In Clark County? What is your stake if you are so passionate about this issue PHAM and always slam La Center.

One more thing Pham. When you say Family Fun Center for A CASINO, are you talking about parents who drop their 2,3, 5, or 8-year-old kids off so the parents can go gamble? If you are, does this mean that on a bad night when "Mommy and Daddy" lost big time that the kids should not be sad when mom and dad are grouchy, in the car or have to scrimp to the next payday or better yet, make excuses why birthday presents can't be bought.

What happens when "Mommy and Daddy" can't stop gambling so leave the kids in playland for 12 hours, plus. There is a reason they have gambling anonymous groups.

Don't take my word though. Look up the articles in Connecticut where they detail people leaving their kids too late and casino personnel having to page them over and over. Nice.Yea.Family fun. Yea Pham. That is the kind of family entertainment we'd all wish for Clark County. A vice driven industry where you most likely will lose money which is why they make the billions they do every year according to the National Indian Gaming Association. NIGA and the NIGC, National Indian Gaming Commission. Look it up.

Whether Curtis is gay or not really means very little. Did anyone happen to see that he is a victim of extortion? Or, does that crime pale in relation to bashing another Republican?

It doesn't make sense to me why if you speak against someone who is gay and a Democrat, it is hate speech. But, it is preferred to bash any Republican who might also be gay.

I guess the days of "someones private life is their business" are long gone, until a Democrat gets back in office!

It seems to me that there is a lot of hypocrits running about. Bash Curtis or any other Republcian who may be gay, but defend any who are Democrat and cry that their sex life is their private business?

Have we come to where anyone who may or may not be gay must walk lockstep with the gay agenda, or be publicly embarrassed?

Did anyone at the Columbain or responders here happen to notice that there was an alleged crime committed against him? Or, does that take a back seat to another chance of bashing a Republican?

Will the Columbian now print all the gorey details of any other gay person in the State Legislature sex life? If not, why not?

It appears that the main thrust ofhomophobia comes from those who gleefully look forward to bashing any Republican they can if they may be gay.

Given the facts presented I firmly believe that Curtis needs to step down. This will demonstrate the vast difference between the left and right. The right will ask that he step down and will expect if not demand that he step down. Rightfully so! The left would re-elect him and make him a hero for the same activity. Republicans who were busted for simply soliciting unethical behavior such as Jim West, Mark Foley, and Larry Craig are looking for another line of work. Again, rightfully so! Democrats who were busted for actual unethical behavior such as Gary Studs who acutally had sex with an underage subordinate young man and not only kept his job, but got re-elected! Barney Frank has a gay lover who runs a prostitution ring out of his home and get re-elected and currently heads some of the most powerfull committees in DC. Ted Kennedy has been re-elected how many times? Didnt he leave a young girl to drown in the back of his car instead of calling the police and potentialy hurting his career? We are talking about a human being who is no longer breathing because of his unethical behavior. Then you can go on to all kinds of other Democrats like William Jefferson and the freezer full of marked FBI bribe money, or Sandy Burger who steals confidential documents from the national archives and lost his top secret clearance with no jail time? What happened to Burger....oh he is working on Hillary Clinton's campaign as an advisor! If I missed any Republicans who are guilty of similar behavior, they need to leave office also. It is one thing to forgive the sinner, but it is another to forgive the sin. I can forgive because we are all human and make mistakes. But re-electing them just because of the letter behind their name is not an acceptable practice if we want to have a strong form of representative government with leaders we can trust and depend upon to make sound and logical decisions.

Yes, he is also a victim. It is hard to get much sympathy up for him when he jumped on the tracks and got hit by this particular train.

His wife and family didn't sign on for this. They have all my sympathy.

First off Lewis this is not a GOP/DEM debate! I am a card carrying GOP and am flat disgusted with Capt Curtis's behavior! I knew him when he worked for VFD and had HAD a great deal of respect for him. Curtis is no more a victim of extortion then a pencil is responsible for spelling errors. He was stupid and got caught up in a situation he wanted to use his power to keep under wraps. He himself didn't want this kid to be prosecuted and has changed his story more often then slick Willie Clinton did.

Whether or not Dick likes dick isn't really at issue here...he tried to stiff (oh I kill myself sometimes) some kid for $1000 he agreed to pay for services rendered. Looks like to me Curtis is the one guilty of a couple crimes here...engaging in prostitution (probably on our tax $'s), and theft of services. And not to mention guilty of bad dressing…red stockings with a black lace top?

Richard, its time to do the right thing and step down.

I wonder how you feel about the four highest grossing cardrooms in the State of Washington that just happen to be located in LaCenter.

These cardrooms don't make their living on winners. Is it okay for families to lose their money in a cardroom versus a CASINO? Just recently there was an incident where a family left their child in a car parked in a LaCenter cardroom parking lot while they were inside gambling. Go inside the four LaCenter cardrooms and you will see the same people there, day after day, night after night. They are losing millions but who cares?

The cardroom owners are fighting mightily to keep the money rolling in. Money lost by people who can probably least afford to lose it. Where is your outrage over this? I guess you see a difference between a CASINO and just a little old cardroom.

If your opposition to the Cowlitz Casino is just that gambling is bad then you need to apply the same logic to the LaCenter cardrooms.

I've read all the reports and heard all the comments. It is a sad situation for all including Curtis himself. I agree with Shannon Barnett regarding the bashing going on one-way all the time. I know that whether you have an (R) or a (D) behind your name you are HUMAN. That means you are prone the sins of the flesh! I am not here to defend anyone for what they did or did't do. BUT, I must step in for the sake of his wife and daughters. THEY are innocent! His wife is a wonderful loving woman whom I could easily trust my life to. She is a caring individual with a contagious laugh and a very compassionate person. I doubt highly that she was aware and accepting of this behavior. The statement made and quoted by the paper is made from the extortionist who threatened to "expose the guy" to his wife. This guy is not only an extortionist but a man who practices unprotected sex and lives a dangerous life in times of AIDS. Every homosexual should be concerned about this kids' behavior as they may have already or may encounter him in the future.

About the Christian bashing ... There a millions of Christians out there that shadow the few who may claim to be! And for those who are quick to judge, just know that Christians are not perfect.Quite the contrary. The Bible says that we are to 'press towards the mark' but we would always miss the target. True Christians would never profess to be perfect as they know that as long as we live in the flesh they are prone to the sins of the world. We are just forgiven. God forgives 70 times 70 on a daily basis. The only one who has walked this earth PERFECT is Jesus Christ Himself. And He died so that our sins would be forgiven. I am praying for the Curtis family and am glad that the light has been shed in this dim world of sin. Perhaps now Curtis could repent, be forgiven, and move on with his life. It is the "Christian thing to do". As for all you 'stone throwers' out there; "LET HE WHO HAS NOT SIN CAST THE FIRST STONE!"

Hey josephine wentzel...actually if you read the reports you will find that it was not the saupposed "extortionsit" that wishesd to have unprotected sex...it wass Curtis that demaned and payed for it...ths one that is married and has 2 daughters. The prostitute is obviously openly gay and made the statement that unprotected sex was unsafe and he didn't want to do it at first. Capt (and former PARAMEDIC of all things) Curtis is the one who insisted on unprotected sex...I hope his wife is headed to the clinc as we speak...

You aer right on one thing though...every homo should be concerned at the Capt's behaviour! Maybe he was friensds with Mayor West...

Hey Lewis...last time I checked engaging someone in a sex for cash (known as PROSTITUTION) is a criminal act! If Curtis did in deed exchange $ for sex he did in fact commit a crime. If additionally he tried to stiff the guy and not pay the agreed price that too also happens to be a crime oddly enough...failure to pay for services rendered. I don't care whether or not it was gay sex...the fact is it was sex with a KNOWN prostitute! Did you read the reports? Plus, the guy lied about it...and apparently lied to police in the beginning and opted to change his story therefore committing yet a 3rd crime.

What a shame. I thought Richard was an asset to the community and a decent man professionally. I certainly hope this dies down in the media and the healing can begin for his family.

Oh ho ho - these metaphors are just too damned funny in this story. If there'd been a "cap" on the "tube", the "toothpaste" never would have gotten out ... this is hilarious! Ho ho ho; ha ha ha; hee hee hee.
